In any list building context,
FUNCTIONNAME (ARGUMENT)
will be interpreted as
FUNCTIONNAME() (ARGUMENT)

No, that wil not work. The code is a function call with a list of indexed output variables. Removing the ~ would put the other variables in the wrong location. It would also not solve the underlying issue which has to do with the difference between
[A, B (D)]
compared to
[A, B(D)]
with the first one being the same as
[A, B(), (D)]
