Privacy Policy

This Privacy Policy (Policy”) describes how MathWorks and its subsidiaries and related companies (collectively, “MathWorks,” “we” or “us”) collect, use and disclose personal information in connection with the recruiting process, as well as what choices you have regarding your personal information.  The laws of a particular country may limit the types of personal information we can collect or the manner in which we can use that information.  In those instances, we adjust our internal policies and practices to meet the requirements of the law.

CONSENT TO PROCESSING AND TRANSFER OF PERSONAL INFORMATION

By clicking that you accept this Policy when creating a Careers Account or otherwise making available personal information to MathWorks during the recruiting process, you acknowledge and agree that:

  • You have received this Policy and consent to MathWorks processing such personal information in accordance with this Policy (e.g., see “How We Use Your Information” below);
  • You consent to the transfer of such personal information worldwide, including to the United States and to other countries that may not be deemed to provide the same level of data protection as your home country, for the purposes and in the manner specified in this Policy (e.g., see “Disclosures of Your Information” below); and
  • You have provided any notices and obtained any consents needed to provide information concerning others (e.g., information about employment references).

Your consent to the provisions of this Policy is required in order to submit or make available personal information to MathWorks. You can refuse to provide your consent by choosing not to submit personal information to MathWorks, and you may withdraw your consent at any time by contacting careersprivacy@mathworks.com as set forth in Part 12 below.  Declining to submit or make available personal information or withdrawing your consent may affect your ability to apply for or receive an offer of employment.

This Policy does not form part of any contract of employment offered to candidates hired by MathWorks.

1. The Types of Information We Collect

As used in this Policy, “personal information” means any information that identifies, or can be used indirectly to identify, an individual job applicant or potential candidate for employment.  Personal information does not include any information that cannot be associated with such an individual.   

Generally, the types of personal information that we collect may include: 

  • Name, address, email address(es), telephone number(s), or other contact information;
  • Resume or CV, cover letter, previous work experience, military experience, other experience, education, transcripts, languages, licenses and/or certifications;
  • Type of employment sought, desired salary, willingness to relocate, and other job preferences;
  • Any sensitive and/or demographic information, to the extent obtained during the application or recruitment process, such as gender, information about your citizenship and/or nationality, medical or health information and/or your racial or ethnic origin (see “Sensitive Information” below);
  • Information from interviews and phone-screenings, if any;
  • How you heard about the position and answer(s) to security question(s);
  • Reference information (it is your responsibility to obtain consent from references before providing their personal information to us) and/or information received from background checks (U.S. only), including information provided by third-parties; and
  • Other information that you choose to provide for MathWorks’ consideration.

You are responsible for the information that you provide or make available to MathWorks, and you must ensure that it is honest, truthful, accurate, and not misleading in any way.  You must ensure that the information provided does not contain material that is obscene, defamatory, or infringing on any rights of any third-party; does not contain malicious code; and is not otherwise legally actionable.  Further, if you provide any information concerning any other person, such as individuals you provide as references, you are responsible for providing any notices and obtaining any consents necessary for MathWorks to collect and use that information as described in this Policy.

2. How We Collect Information

Submitting your application information is voluntary, and you determine the extent of information, if any, you provide to us.  If you choose not to submit your application information, our ability to consider you as a candidate may be limited.  In addition, you agree that, in addition to collecting information directly from you, MathWorks may collect information about you from third-parties—for example, from recruiters, from MathWorks employees with whom you have interviewed, in connection with a background or employment check (U.S. only) or an employment reference, or from a recruiting or other web site to the extent permitted by applicable law. 

MathWorks’ websites, including the Careers websites, may use cookies and other electronic communication protocols.  For further information, please consult the MathWorks Privacy Policy.

3. How We Use Your Information

MathWorks collects and uses your information with your consent and for legitimate human resources and business management reasons in connection with its job application and recruitment processes, including:

  • Communicating with you about the recruitment process and/or your job applications, including, in appropriate cases, informing you of other potential career opportunities at MathWorks;
  • Assessing your skills, qualifications and interests against our career opportunities;
  • Verifying your information, and conducting reference checks;
  • Conducting background checks if you are offered a job (U.S. only);
  • Record-keeping in connection with our recruiting and hiring processes;
  • Creating and/or submitting reports as required under applicable laws or regulations, and otherwise complying with applicable laws and regulations, enforceable governmental requests and corporate governance requirements; and
  • Defending against legal claims, as necessary.

In addition to using your information in connection with position(s) to which you have applied, we may use your personal information to consider you for other potential career opportunities at MathWorks. If you do not want to be considered for other potential career opportunities at MathWorks, you may contact us at careersprivacy@mathworks.com as described in Part 12 below.

We also may use information on an aggregated and/or anonymized basis to improve and inform our recruitment and hiring process and our ability to attract successful candidates.

If you accept employment with MathWorks, your information will be used in connection with your employment in accordance with MathWorks’ employment policies.

4. Sensitive Information

MathWorks does not request or require sensitive information concerning race, color, religion, sex, national origin, ancestry, age, veteran status, disability, sexual orientation, gender identity, genetic information, marital status, medical condition, pregnancy, handicap, political affiliation, or other protected status in connection with recruiting. In some countries, MathWorks asks for information such as race, ethnicity, and gender to monitor equal opportunity; however, we do not require race, ethnicity, or gender information, and, if you provide this information, it is not viewable in the hiring or selection process.

To the extent that you choose to provide information such as, but not limited to, your racial or ethnic origin; political opinions or beliefs; religious beliefs; membership in a trade union or political party; physical or mental health or condition; sexual orientation; gender identity; genetic information; commission or alleged commission or an offense related proceedings; job evaluations, or educational records; you expressly authorize MathWorks to handle such information in accordance with this Policy.

5. Data Retention and Deletion

We retain your information for as long as necessary to consider you for employment at MathWorks.  If you accept employment with MathWorks, any relevant information collected during your pre-employment period will be retained in accordance with MathWorks’ employment policies.  If we do not employ you, we will continue to retain your personal information for system administration purposes, to consider you for other possible career opportunities at MathWorks, for compliance with applicable laws and regulations and to defend against legal claims, as necessary. During the recruitment process, European Union (“EU”) data subjects will have an opportunity to consent to a period of two (2) years for such continued retention, which consent may be withdrawn at any time by contacting us at careersprivacy@mathworks.com as described in Part 12 below.  If such an individual chooses not to provide or withdraws such consent, we continue to retain his or her personal information for twelve (12) months following completion of the most recent job application process that did not result in employment (unless a shorter period is required by law).  For career opportunities outside of the EU, applicable laws and regulations may allow or require us to hold information for a longer period of time.

At the end of the applicable retention period, or upon your request in certain circumstances (see “Your Choices About Your Information” below), we will delete your personal information, except for information necessary to comply with applicable laws or regulations or to defend against potential legal claims as required or allowed by applicable law, and provided further that we continue to retain information on an aggregated and anonymized basis to improve and inform our recruitment and hiring processes and our ability to attract successful candidates.

Please note that MathWorks may delete data at any time; therefore, you should retain your own copy of any information you submit to us.

6. Disclosures of Your Information

MathWorks does not sell or rent your personal information, and we will not disclose your personal information, except in the limited manner and for the limited purposes described below. 

As a global company headquartered in the United States, MathWorks may collect, process and transfer your personal information to MathWorks in the United States and to MathWorks’ offices in other countries and territories around the world.  Like many companies, this allows us to centralize certain aspects of our data processing and human resources administration in the United States to better manage our business.  Certain administrative staff will have access to some of your personal information if access to such information is necessary for the purposes described in this Policy.  For example, Recruiting staff access certain of your personal information in order to assess your skills, qualifications and interests against our career opportunities, and MathWorks employees conducting your interviews or phone screens, if any, access certain of your personal information in performing such interviews or screens.  Such access will be restricted, and your information will be secured and protected.  (See “How Your Information is Protected” below.)  With respect to such processing and transfer by and among MathWorks and its affiliates, MathWorks and its affiliates have entered into and executed an Intercompany Data Protection Agreement, which incorporates the European Union Model Clauses requirements for the transfers of your personal information.

In addition, MathWorks discloses certain of your personal information to third-parties in the United States and other countries and territories where MathWorks does business.  We disclose your information only as necessary to perform the services described above and to verify the information you provide to MathWorks (e.g., by contacting job references that you provide, or verifying your educational degrees).  Such third-parties include service providers acting on MathWorks’ behalf to perform some of the services described above, including recruiting software and related services and background checks (U.S. only).  A list of the third-party service providers with whom we share your personal data is available to you upon request.  You may submit requests to review the list of such third-parties in writing to careersprivacy@mathworks.com.

Some of the recipients described above may be located in countries that do not offer the same level of data protection as the country where you reside, which may include countries outside of the European Economic Area (“EEA”), including the United States, where the level of data protection is not recognized by the European Commission as being commensurate with the EU General Data Protection Regulation (“GDPR”). 

In all instances, MathWorks will only disclose your personal information in accordance with this Policy and applicable law, and we will endeavor to ensure that recipients process and use your personal information only on our behalf and in accordance with our instructions.  Many of our vendors are certified under the EU-U.S. and Swiss-U.S. Privacy Shield frameworks, which means that it has been determined that they provide an adequate level of protection to your personal information.  For other recipients, we will only disclose your personal information where we have obtained your consent, where the transfer is necessary for the preparation or performance of your employment contract or other contracts concluded in your interest (if you are hired by MathWorks), where doing so is necessary for the establishment, exercise or defense of legal claims, or where doing so is otherwise permitted by applicable law.  Where required by applicable law, we use a contract when we share personal information with other third-parties requiring the recipient to protect your personal data in compliance with law.  If you have questions about the safeguards that we use to protect your data or would like to request a copy, you can contact us at candidateprivacy@mathworks.com.

7. Third-Party Services

In certain circumstances, you may provide information directly to third-parties engaged by MathWorks to make products or services available to you during the recruiting process.  In such instances, you may provide personal information directly to the third-party in order to take advantage of such products or services.  The use of such third-party products and services may be governed by separate terms of use and privacy policies that are not under our control.  Please contact such third-parties for questions or concerns regarding their privacy practices.

8. Your Choices About Your Information

MathWorks complies with applicable privacy laws, including the GDPR, and adheres to fair information practice principles.  If you are subject to the GDPR or other applicable privacy laws, you have the right to make certain requests about your personal data.  You have the right to request access to your personal data, request that MathWorks correct your personal data so that it is accurate and up to date, or request that your personal data be restricted or removed.  You have the right to object to the processing of your personal data on the grounds that the processing is not lawful.  You have the right to data portability, the right to withdraw consent to processing, and the right to lodge a complaint with a supervisory authority.  This section describes these rights.

For GDPR purposes, The MathWorks, Inc. and each of its local offices (contact details available here) are joint controllers of information collected and processed hereunder, and MathWorks’ representative in the European Union is The MathWorks GmbH, Adalperostr. 45, München (Ismaning), 85737, Germany.  

Accessing Your Personal Information

If you ask to see the personal information that we hold about you, we will endeavor to provide such information in a structured, commonly used format.  Please note that we may first request specific information from you in order to confirm your identity, as well as to search for and provide you with the personal information we hold about you.

Your right to access the personal information that we hold about you is not absolute.  There are instances where applicable law or regulations allow or require us to refuse to provide some or all of the personal information that we hold about you.  In addition, certain personal information may have been destroyed, erased or made anonymous. 

In the event that we cannot provide you with access to your personal information, we will endeavor to inform you of the reasons why, subject to any legal or regulatory restrictions.

Correcting Your Personal Information

We endeavor to ensure that personal information in our possession is accurate, current and complete.  If you believe that the personal information we have about you is incorrect, incomplete or outdated, you have the ability to correct certain information through our Careers website, and you may request that we revise or correct your information.   If it is determined that personal information is inaccurate, incomplete or outdated, we will use reasonable efforts to revise it and, if necessary, use reasonable efforts to inform agents, service providers or other third-parties to whom we may have provided inaccurate information so records in their possession may be corrected or updated to the extent possible.

Deleting Your Personal Information; Objections; Restriction Requests

You may request that we delete the personal information that we hold about you, and, in certain instances, you may object to or request that we restrict our use of such information.  There are instances where applicable law or regulations allow or require us to refuse such requests.  In the event that we cannot delete your personal information or restrict our use of it, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

Please send requests to access, correct or delete your personal information, and all other requests regarding your personal information, to careersprivacy@mathworks.com as set forth in Part 12 below.  Please note that any request by you to delete your personal information will not result in deletion of any information submitted by you directly to a third-party provider.  If you require the third-party to delete any of your personal information, you must contact the third-party directly to request deletion.

Automated Decision-Making

MathWorks generally does not make recruiting or hiring decisions based solely on automated decision-making within the meaning of the GDPR.  In the event that MathWorks does rely solely on automated decision-making that could have a significant impact on you, MathWorks will provide you an opportunity for you to request human intervention and to express your views and will provide any other safeguards required by law.

9. How Your is Information Protected?

We are committed to protecting the security of your personal information, and we take reasonable physical, electronic and administrative measures to safeguard your personal information from unauthorized or inappropriate access or use.  Only authorized personnel of MathWorks and of our third-party service providers are provided access to personal information, and such personnel and third-party service providers are required to treat this information as confidential.

10. Changes to this Policy

MathWorks may modify this Policy at any time, and such modifications shall be effective immediately upon posting of the modified Policy.  Notification of material changes to this Policy will be provided by noting an updated date at the beginning of this Policy.  Where your consent is required for the collection, use or disclosure of your personal information in specific cases, any change that relates to why we collect, use or disclose such information for such cases will not apply to you until we have obtained your consent to such change.

11. Interpretation of this Policy

This Policy includes examples but is not intended to be restricted in its application to such examples.  Therefore, where the word “including” is used, it shall mean “including without limitation.”

This Policy does not create or confer upon any individual any rights, or impose upon MathWorks any rights or obligations outside of, or in addition to, any rights or obligations imposed by the privacy laws applicable to such individual's personal information.  Should there be, in a specific case, any inconsistency between this Policy and such privacy laws, this Policy shall be interpreted, in respect of that case, to give effect to, and comply with, such laws.

13. California Candidate Supplemental Privacy Notice and Policy

This California Candidate Privacy Notice and Policy (“CA Policy”) supplements the Jobs at MathWorks Privacy Policy (“Policy”). This CA Policy applies to the personal information we collect from candidates who are California residents.

Notice of Information We Collect and Have Collected

We may collect and have collected within the last 12 months, the following categories of personal information from California applicants:

Identifiers such as name, home address, telephone number, email address, account name, and if hired MathWorks may additionally collect social security number, driver’s license number, passport and visa information, date and/or city of birth, residency, image, emergency contact details; financial information including payroll, banking and benefit information.

Protected Characteristics:  Such as age, gender, race or ethnicity, marital status, veteran or military status, medical and other information as voluntarily reported by applicants in connection with Equal Employment Opportunity reporting.

Commercial information Such as any travel and expense information for reimbursement purposes.

Biometric information MathWorks does not collect biometric information from applicants.

Internet and Other Network Activity: such as IP address, activity across MathWorks' network as aggregated by Adobe Analytics or other web analytics service providers, or other browsing activity.

Geolocation Data MathWorks does not collect the precise geolocation data of applicants.

Electronic, Audio, Visual, Thermal Data: such as information captured on security systems if applicant visits a MathWorks campus;

Professional and Employment Data: Such as employment history, qualifications, licenses, permits or certifications, and information from reference checks.

Education Information (non-public):  For example, academic transcripts if voluntarily submitted by applicants.

In most cases the information we collect will have been provided by the applicant, but some information may come from other sources, such as recruiters, MathWorks employees with whom an applicant has interviewed, employment or other references, or service providers, such as the results of a background check conducted with an applicant’s consent.

Please refer to Section 3 of the Policy “How We Use Your Personal Information” for a detailed list of the business purposes for which we collect and process information and Section 5 of the Policy “Data Retention and Deletion” for the criteria used to determine the retention period for this information. In the preceding twelve months, we have disclosed the types of personal information listed above to service providers to enable them to provide services on your behalf.

In the preceding twelve months, we have not sold or shared applicant personal information identified in the above categories to any third party as these terms are defined by the CPPA.

California Residents have the following rights pursuant to the CCPA (as amended by the CPRA), subject to certain statutory exceptions:

Right to Know. You have the right to know the categories of personal information collected by us, and a right to access your personal information. This includes the categories of sources from which we collect personal information, the commercial purpose of collection, the categories of personal information that we disclosed for a business purpose (since Jan. 1, 2022), and the right to receive information about the specific pieces of your personal information collected in this time period. You have the right to know the categories of personal information sold as well as the categories of third parties to whom such personal information was sold. (MathWorks has not sold or shared the personal information of applicants to any third party as these terms are defined by the CPPA/CPRA.)

Right to Delete Personal Information. You have the right to request the deletion of the personal information that we have collected. Please note that in certain instances we may refuse to delete information that we are required to retain in order to comply with other laws or legal obligations.

Right of Correction You have the right to request correction of inaccurate personal information.

Right to Opt-out of Sale or Sharing of Personal Information. Within the meaning of the CCPA, we have not sold or shared applicant personal information to any third party.

Right to Limit Use and Disclosure of Sensitive Information.  Within the meaning of the CCPA, we do not use sensitive personal information for inferring characteristics of applicants. Sensitive personal information that is collected or processed without the purpose of inferring characteristics is not subject to this provision.

Right to Non-Discrimination. You have the right to be free from discrimination by us as a result of you exercising your rights under the CCPA.

California applicants may submit requests to exercise their rights under the CCPA by (a) emailing careersprivacy@mathworks.com; (b) submitting a privacy request via a  Customer Support privacy request or (c) by calling the toll-free number (1) 833-917-2250. When you submit a request, we will need to verify your identity. We may need to request additional information in order to verify your identity. You may designate an authorized agent to request information on your behalf. If you elect to use an authorized agent, we may still require you to verify your identity directly with us and to verify your authorization of the agent.
